Plant varieties do not as a matter of principle enjoy protection through patents. It is instead possible for plant breeders to have their plant protected as a plant variety, on the proviso that the protection prerequisites as regards distinctiveness, homogeneity, resistance and novelty are met and the variety is denominated by a registrable descriptor. Plant-variety protection is valid for 25 or 30 years depending on the plant variety.
